Judgment Details:- Poosa Sri Krishna & Ors. vs. Gattu Kishan Rao & Anr. 2026 INSC 974 Supreme Court of India 31 August 2026 She paid money to get a loan — allegedly including money meant to influence bank officials. When the loan was never delivered, she went to court seeking recovery. But the Supreme Court held that the suit could not proceed. Why? This episode explains the legal principle of “In Pari Delicto” — a doctrine associated with situations where both parties are involved in an unlawful transaction. The story involves Sunita Devi from Godavarikhani, Telangana, who allegedly paid money to an agent for arranging a bank loan. The pleadings stated that the money was connected with influencing bank officials and exchanging old demonetized currency notes. The Supreme Court examined the pleadings in light of Section 23 of the Indian Contract Act, 1872, which deals with unlawful consideration and objects, and considered the principle of In Pari Delicto. The case also involved Order VII Rule 11(d) of the CPC, under which a plaint can be rejected where the suit appears from the statements in the plaint to be barred by law.
