क्या किसी ज़मीन पर 40 साल तक कब्ज़ा करके खेती करने से कोई व्यक्ति उस ज़मीन का मालिक बन सकता है? क्या मंदिर, डेरा या धार्मिक संस्था के नाम पर लंबे समय से कब्ज़ा होना मालिकाना हक़ साबित कर देता है?
इस कहानी में सुप्रीम कोर्ट ने एडवर्स पजेशन (Adverse Possession) और राजस्व रिकॉर्ड (Revenue Records) से जुड़े बेहद अहम कानूनी सिद्धांतों को स्पष्ट किया।
मामला पंजाब की करीब पौने पांच कनाल ज़मीन का था, जिस पर दशकों तक एक धार्मिक संस्था का कब्ज़ा रहा। विवाद 1965 से शुरू होकर करीब 40 साल तक चला और मामला ट्रायल कोर्ट, फर्स्ट अपीलेट कोर्ट, पंजाब-हरियाणा हाई कोर्ट होते हुए सुप्रीम कोर्ट तक पहुंचा।
सुप्रीम कोर्ट ने स्पष्ट किया कि सिर्फ लंबे समय तक कब्ज़ा होना पर्याप्त नहीं है। Adverse Possession के लिए कब्ज़े का खुला, लगातार और असली मालिक के अधिकार के खिलाफ Hostile होना साबित करना जरूरी है।
इस फैसले में यह भी स्पष्ट हुआ कि जमाबंदी और खसरा-गिरदावरी जैसे राजस्व रिकॉर्ड अपने आप मालिकाना हक़ (Title) पैदा या खत्म नहीं करते।

Can 40 years of possession over a piece of land make someone its legal owner? Does possession in the name of a temple, dera, or religious institution automatically establish ownership?
This Supreme Court case explains the important legal principles surrounding Adverse Possession, Revenue Records, Possession and Title.
The dispute involved around four-and-three-quarter kanals of land in Punjab and continued for decades, passing through the Trial Court, First Appellate Court, Punjab & Haryana High Court and finally the Supreme Court.
The Supreme Court clarified that long possession alone is not enough to establish adverse possession. The possession must be open, continuous and hostile to the true owner's title, and the hostile nature of the possession must be established with evidence.
The judgment also clarified that Jamabandi and Khasra Girdawari/revenue entries do not by themselves create or extinguish title.
