Adverse Possession is a legal principle under which a person in continuous possession of another person’s immovable property may, in certain circumstances, acquire a legally enforceable title if the possession is open, continuous, exclusive, hostile to the true owner, and maintained for the statutory period. Under Article 65 of the Limitation Act, 1963, a suit for possession of immovable property based on title generally carries a limitation period of 12 years, calculated from the point when the defendant’s possession becomes adverse to the plaintiff. Section 27 provides that, upon expiry of the prescribed limitation period for a possession suit, the person’s right to the property may be extinguished.
