Sandra Birchmore's death investigation led to an extraordinary admission in Matthew Farwell's federal trial: the detective who interviewed Farwell in a school parking lot said the decision to record nothing and take no notes came from his supervisor, then-Sgt. John Fanning. The stated reason was to keep Farwell talking instead of prompting him to ask for a lawyer. What does that decision mean when the person being questioned is a police officer seen entering and leaving the woman's building? Trooper Matthew Dunne testified that he later learned Farwell had given false information about when his relationship with Birchmore began and how often they met. Dunne also acknowledged that he did not interview Farwell's Stoughton Police Department colleagues. The state inquiry initially treated Birchmore's death as self-inflicted. Federal prosecutors allege Farwell killed her and staged the scene; Farwell has pleaded not guilty and maintains she took her own life. And the records at the center of the investigation raise another question. State Police digital examiner Nicholas Guarino testified that a search of Farwell's phone did not show messages with Birchmore, after which the phone was returned. Federal examiners later recovered extensive communications from Birchmore's devices. Separately, testimony about Stoughton police leadership raised questions over when the department saw surveillance video of Farwell at Birchmore's building. Tony Brueski, criminal defense attorney Bob Motta and former prosecutor Eric Faddis examine what investigators were expected to preserve, why a supervisor's choices matter, and how a series of decisions can leave a family without an answer. The testimony establishes what witnesses say happened. Whether those decisions amounted to a coordinated cover-up is a separate allegation that requires proof.
