CAN A CRIMINAL CASE BE DISMISSED AFTER SIX YEARS OF DELAY? | PEOPLE VERSUS SANDIGANBAYAN | G.R. NO. 274922
Can the government prosecute you after leaving your criminal case unresolved for more than six years? No, if the delay unjustifiably violates your constitutional right to the speedy disposition of cases.
In People of the Philippines versus Sandiganbayan, Teddy C. Tumang, and William B. Colis, G.R. Number 274922, February 17, 2025, the Supreme Court upheld the dismissal of criminal cases involving alleged violations of the Anti-Graft and Corrupt Practices Act and malversation of public funds.
The complaint was filed with the Office of the Ombudsman in December 2017. Although probable cause was found in 2018, the respondents’ motions for reconsideration were resolved only in April 2024. The Supreme Court found the delay unjustified and affirmed the dismissal.
KEY LEGAL DOCTRINE: Under Cagang versus Sandiganbayan, courts assess the length of delay, the reasons for it, when the right was invoked, and the prejudice suffered by the accused. The COVID-19 pandemic did not justify the entire period of inaction.
The Court ruled that the dismissal was tantamount to an acquittal, triggering double jeopardy and preventing the cases from being reopened.
TLG LEGAL INSIGHT: The government has the power to prosecute, but it must act with reasonable diligence. The constitutional right to speedy disposition protects individuals from unjustified delays in criminal and administrative proceedings.
