In qualifying cases, work conditions may be varied so that wider employment, self-employment or voluntary work becomes possible, subject to the Immigration Rules. We also explain the expansion of the Victim of Domestic Abuse route to certain adult dependent children where the relevant family relationship has permanently broken down because of domestic abuse. Eligibility is not automatic. Previous immigration permission, the relevant sponsor, the circumstances of the breakdown and supporting evidence may all be important. The video also looks at the Family Returns Process and the limited circumstances in which an Article 8 human rights claim based on family life or private life may be raised directly with Home Office staff without the usual formal application, specified form or fee. Timing can be critical, especially where an earlier EUSS application has already been rejected or refused. We also explain important protections for certain children who derived residence rights through an EEA worker or self-employed parent and who continue in education in the UK. In some circumstances, related rights may also extend to a primary carer and dependent children. Finally, we explain the Hong Kong BNO settlement change affecting eligible dependent children. In qualifying cases, a dependent child may be able to settle alongside their parents without completing a separate five-year continuous residence period.
