In the year 2014, the Supreme Court of India, while giving judgement in the case of Arnesh Kumar vs State of Bihar, 2014, had said that in any crime in which there is a provision of imprisonment up to 7 years, the police cannot arrest the accused directly. In this order, the police was ordered to follow the procedure. But in the year 2023, Jammu and Kashmir High Court has to issue guidelines that the police should follow the 2013 orders of the Supreme Court. It is clear that the police is continuously busy arresting the accused, ignoring even the order of the Supreme Court.
