A custody exchange gone wrong, a scratch on her face, and an arrest that the judge called false. In this small claims case, 29-year-old Mr. Tatum sues the mother of his five-year-old son, 25-year-old Ms. West, for false arrest. She files a counterclaim for a false child protective report.
Tatum says he took his son to the emergency room in September 2023 after noticing two long welts on the boy’s back. Child Protective Services got involved, and he was given temporary custody. West says the boy’s brother hit him, but she could not give the judge a name. In November, a custody hearing was dismissed while Tatum was in the restroom, and West believed she still had full custody.
At the next exchange, the boy did not come back. West went to Tatum’s house with her sister, blocked his car, and the two argued. She says he slapped her, and he was arrested for assault. He says he never touched her. The charges were dropped about eight months later. The judge looked at the photo of the scratch and said it did not look like a fresh slap mark.
The court dismissed Ms. West’s counterclaim, because the child protective report was valid. The judge awarded Mr. Tatum $2,500 for false arrest.
In this video, we break down:
The custody order and the week-on week-off schedule
The welts, the emergency room visit, and the child protective report
The courthouse mix-up on November first
The custody exchange, the blocked car, and the arrest
Why the judge questioned the photographs and the credibility of the defendant
Why the counterclaim for a false child protective report was dismissed
The legal explanation in simple words: false arrest, malicious prosecution, good-faith reports, custody orders, and burden of proof
Note: This case involves a sensitive topic, child safety. The judge did not decide who hurt the child.
