Two First Amendment auditors were filming from a public sidewalk outside a bank in Senatobia, Mississippi, when a police encounter took a shocking turn. What started as a call about people recording license plates quickly escalated into a detention, demands for identification, and a threat of arrest. The encounter raises serious questions about the Fourth Amendment, reasonable suspicion, and whether police can threaten to arrest someone simply for refusing to provide identification. The officers eventually allowed the auditors to leave, but the situation didn't end there. Mr. Moses went to the police department to file a complaint and request public records. In this video, we examine the bodycam encounter, the legal principles behind investigative detentions, and the limits of police authority under the Fourth Amendment and First Amendment. Officer Lowry and Lieutenant Hal receive an F in the transcript's legal analysis, while the auditors receive an A-minus for their conduct during the encounter.
