*“That we are challenging.”* Just four words from Solicitor General *Tushar Mehta* — referring to the Uttar Pradesh government’s decision to challenge the *Allahabad High Court order directing ₹5 lakh compensation to be recovered from an officer’s salary.* The case concerns **Akriti Chaudhary**, a 24-year-old law student whose NSA detention was quashed by the High Court. The court found that the grounds for detention were not supported by evidence and directed that the compensation be recovered from the concerned officials. The officer is **Medha Roopam, Gautam Buddh Nagar’s District Magistrate**. Now the bigger question before the Supreme Court: *When an official order is found unlawful, should compensation come from the public exchequer — or can the officer personally be held liable?* Meanwhile, another student from the same district, **Akshat Tripathi**, has approached the Supreme Court after receiving a preventive-action notice under **Section 130 of the BNSS**, requiring a ₹5 lakh personal bond. The government clarified that the notice was issued by the **Executive Magistrate, not the DM**. But the CJI observed that the notice required the student to appear before the Noida DM. Tripathi now argues that such preventive proceedings could effectively circumvent the impact of an earlier Supreme Court order concerning the protest. So, in just eight days: *September 1:* Supreme Court order on the protest-related FIRs. *September 2:* Allahabad HC quashes NSA detention and orders ₹5 lakh compensation. *September 4:* Student receives preventive-action notice. *September 9:* Supreme Court hears the issue, while the government challenges the compensation order. The larger question is simple: *If an unlawful order causes compensation, who should ultimately pay — the taxpayer or the officer who made the decision?* And if the Supreme Court stops one course of action, *can the same outcome be achieved through preventive proceedings?* *What do you think?
