This appeal concerns the ownership of a parcel of land at Morne Du Don, Castries, Saint Lucia (Block 1048 Parcel 434). The appellants, the Toussaints, were the Defendants/Counterclaimants at first instance, while the respondent, the late Peter Barnard, was the Claimant. Mr Barnard brought a claim for trespass and injunctive relief against the Toussaints. The High Court dismissed both the claim and counterclaim, finding that the land belonged to a third party, Tanburn Estates Ltd. The Court of Appeal upheld that decision. The Toussaints have appealed to the Caribbean Court of Justice, contending that they are entitled to the land as heirs of Andrew Jackson, who they allege purchased it in 1888, and alternatively by prescription. The appeal raises issues relating to registered title under Saint Lucia’s land registration system, rectification of first registration on the grounds of fraud or mistake, and the requirements for establishing title by prescription. The respondent has not challenged the lower courts’ finding that the land belongs to Tanburn Estates Ltd and opposes the appeal. The matter is scheduled to be heard in person in Saint Lucia on 8 October 2026.
