#GyaneshKumar #JusticeUjjalBhuyan #SupremeCourt #SIR #ElectionCommission #CEC #VoterList #VotingRights देश में SIR, voter list deletion और Chief Election Commissioner Gyanesh Kumar को लेकर चल रहे विवाद के बीच Supreme Court के Justice Ujjal Bhuyan का मतदान के अधिकार को लेकर बड़ा बयान सामने आया है। Justice Ujjal Bhuyan ने कहा कि अगर किसी प्रक्रिया के कारण लाखों भारतीय नागरिक अपने मतदान के अधिकार से वंचित हो जाते हैं और अपने ही देश में बिना वोट के अधिकार वाले “दूसरे दर्जे के नागरिक” बन जाते हैं, तो ऐसी प्रक्रिया मूल रूप से मनमानी है और संविधान की मूल भावना के खिलाफ है। हालांकि Justice Bhuyan ने अपने बयान में Gyanesh Kumar या Election Commission की SIR प्रक्रिया का सीधे नाम नहीं लिया, लेकिन उनकी टिप्पणी ऐसे समय आई है जब देश में SIR और voter list से नाम हटाए जाने को लेकर बड़ा राजनीतिक और कानूनी विवाद चल रहा है। वहीं पूर्व Supreme Court Judge Justice Rohinton Fali Nariman ने भी Election Commission की कार्यप्रणाली और मतदाता सूची से नाम हटाए जाने को लेकर गंभीर सवाल उठाए हैं। इसी बीच पूर्व नौकरशाहों, नागरिक अधिकार कार्यकर्ताओं और सामाजिक कार्यकर्ताओं के एक प्रतिनिधिमंडल ने CEC Gyanesh Kumar के खिलाफ “People’s Notice of Impeachment” और आरोप-पत्र Election Commission को सौंपने की कोशिश की। प्रतिनिधिमंडल में पूर्व दिल्ली LG Najeeb Jung, पूर्व केंद्रीय गृह सचिव G.K. Pillai, Yashovardhan Azad, Yogendra Yadav, Anjali Bhardwaj समेत कई लोग शामिल थे। समूह का कहना है कि Election Commission के मुख्यालय तक जाने वाले रास्तों पर बैरिकेडिंग होने के कारण वे पत्र नहीं सौंप पाए और बाद में Press Club में अपनी बात रखी। उनके आरोपों में Election Commission के सामूहिक कामकाज को प्रभावित करना, Form 6 में कथित अनधिकृत बदलाव, electoral roll system का केंद्रीकरण, SIR के जरिए कथित mass disenfranchisement और वैधानिक कर्तव्यों के उल्लंघन जैसे मुद्दे शामिल हैं। ये प्रतिनिधिमंडल द्वारा लगाए गए आरोप हैं, जिन पर अंतिम कानूनी निष्कर्ष अभी नहीं आया है। अब सवाल उठ रहे हैं—क्या SIR के तहत मतदाता सूची में हुए बदलावों की न्यायिक जांच और गहरी होगी? Amid the ongoing controversy over SIR, voter roll deletions and Chief Election Commissioner Gyanesh Kumar, Supreme Court Justice Ujjal Bhuyan has made significant observations on the constitutional importance of voting rights. Justice Bhuyan said that any process that disenfranchises millions of Indian citizens and effectively turns them into “second-class citizens” without voting rights is intrinsically arbitrary and strikes at the heart of the constitutional order. Justice Bhuyan did not directly name Gyanesh Kumar or the Election Commission's SIR exercise in his remarks. However, his comments have drawn attention because they came amid an intense national debate over voter-list revisions and alleged mass disenfranchisement. Former Supreme Court judge Justice Rohinton Fali Nariman has also raised serious concerns over the functioning of the Election Commission and alleged illegal deletion of voters from electoral rolls. Meanwhile, a delegation of former civil servants, activists and citizens attempted to submit a “People’s Notice of Impeachment” and a chargesheet against CEC Gyanesh Kumar to the Election Commission. The delegation included former Delhi Lieutenant Governor Najeeb Jung, former Union Home Secretary G.K. Pillai, Yashovardhan Azad, Yogendra Yadav, Anjali Bhardwaj and several others. The group alleged violations involving the collective functioning of the Election Commission, changes to Form 6, centralisation of electoral-roll administration, alleged mass disenfranchisement through SIR and breach of statutory duties.
