ConCourt finds Public Procurement Act unconstitutional and invalid

The Constitutional Court has ruled that the Public Procurement Act of 2024 is unconstitutional and invalid. This follows the Western Cape Government, the City of Cape Town, Amabhungane Centre of Journalism and Solidarity turning to the apex court to determine the Act's validity. In their view, the legislative institutions, namely Parliament and the NCOP, did not fulfil their constitutional obligation of ensuring a reasonable level of public participation in the legislative process.
