No Body, No Jury: Anesthesiologist Says Even 3cc Would Leave a Man Unable to Resist, Full Testimony

The State's anesthesiologist explains the paralytic at the center of its case: you cannot move, you cannot breathe, and you are awake for all of it. A plastic surgeon sued for money, stopped defending the case, and was weeks from losing it when the lawyer on the other side disappeared. No body has ever been found. Tomasz Kosowski has fired every lawyer he had, given up his right to a jury, and now defends himself against the death penalty. Steven Cozzi is the lawyer who vanished, and a vial of succinylcholine is part of what the State says Kosowski was carrying. Dr. Hector Vila Jr. has practiced anesthesiology since 1991, owns a pediatric dental anesthesia practice in Tampa, trained residents for years, and sits on the Florida Board of Medicine. He tells the court succinylcholine is a muscle relaxant, not a sedative. It paralyzes every muscle you use to breathe while your heart keeps pumping, and without a sedative the person stays completely aware and can still feel everything. Given in a vein it works in 30 to 90 seconds. Given in a muscle, a minute to three. He is handed the State's exhibit, an unopened vial with a needle and a 3cc syringe, and explains that office surgery centers are required to keep this drug on hand. Then come the hypotheticals. A full vial, for a man around 5'10" and 190 pounds with no one breathing for him, he calls "very likely" lethal, and even if it were not, he puts that man flat for at least eight minutes and more likely 10 to 15. Even the 3cc syringe, he says, would leave that man with little or no ability to resist or move. The last stretch walks through web searches the State says came from Kosowski's devices: onset, injecting into a muscle, how long it lasts, and its dangers, including pages about using a smaller dose so it wears off sooner. Why does a pharmacology lesson matter this much? Because this is a no-body case. There is no autopsy and no cause of death on the record, so the State is building a mechanism instead: a drug that can leave a grown man helpless in about a minute while he stays fully awake. On September 23, 2026, Judge Bulone found Kosowski guilty of first-degree murder in the death of Steven Cozzi, whose body has never been found.
