The uncle on trial watched the State's investigator measure the red earbuds for the jury. Then came his opinion.
This is the trial of David Prevatte in Pender County, North Carolina. He is charged in the 2017 death of his five-year-old niece, Paitin Fields. He has said he found her and tried to save her. The State named him a suspect in 2018 and did not charge him until 2022, and I am still waiting to hear what changed in between. He is presumed innocent. I am not the jury, and only those twelve people decide.
On Day 7 the State called Investigator Eric Short of the District Attorney's office, and this stretch of his direct examination is where the State tries to connect one object from that house to Paitin. He tells the jury he started with a belt and set it aside as too wide. He says he then went back through the cords collected from the home, and that the red earbuds were the only item in evidence with a loop that was consistent, "in my opinion," with the pattern he saw in the photographs. Listen for those three words. He uses them twice.
Then he gets specific. He says he put a digital caliper on the cord and read .115 inch for one strand and 0.206 inch with two strands side by side, both under the width he says the mark allows. He steps down to the courtroom screen with a pointer and walks the jury through his own photographs, including a section of the cord he describes as rippled and stretched. Then the State hands him the evidence bag. He pulls on gloves, takes the earbuds out, and carries them over to the jury.
Keep a few things straight while you watch, because they matter. This is one investigator's opinion, given on direct examination. Nobody from a lab takes the stand in this clip to compare the earbuds to the mark. When he says the pathologist, Dr. Karen Kelly, "advised me it was consistent," that is his account of a conversation with her, and she is not the one testifying here. When he mentions DNA findings near the end, that is his own summary, and no lab result is read in this stretch. The defense has not asked him one question yet.
He also agrees the earbuds had already been to the state crime lab and been swabbed before he ever put a caliper on them, and that when the bag is opened in court they look like a bird's nest. So here is what I am asking. How much weight can one man's measurements and one man's reading of a photograph carry before the other side has tested any of it? I want to see what the cross-examination does with this.
