Hearing of the Application - BB/A/CV2026/001 Stephen Ward v Bjorn Bjerkhamn

1. Mr Bjerkhamn had applied to the High Court to enforce a 2015 Order of the CCJ in Walsh et al v Ward et al [2015] CCJ 14 (AJ), wherein this Court had ordered that Mr Ward be at liberty to convey a plantation of approximately 125 acres to Mr Bjerkhamn. 2. Mr Ward made a preliminary objection to Mr Bjerkhamn’s application, questioning whether the 2015 Order was capable of being enforced by Mr Bjerkhamn. The High Court dismissed that objection and granted Mr Bjerkhamn’s application for enforcement. Mr Ward’s appeal to the Court of Appeal was considered to be out of time, and his application for an extension of time and for a stay of the High Court judgment was dismissed. 3. Mr Ward has now applied for special leave to appeal that decision of the Court of Appeal, and for clarification of the 2015 Order of this Court.
