The defense asked the trooper who investigated the crash if he suspected a crime that night. Watch his answer, then what the State asks him next. This is the Dying Last Words Trial: State of Florida v. Leigha Mumby, in Flagler County, Florida. On the night of February 9, 2025, the white Honda Passport Leigha Mumby was driving left I-95 northbound and hit a tree. Her boyfriend, Daniel Waterman, 22, was in the passenger seat. He died that October. She is on trial for vehicular homicide and reckless driving causing serious bodily injury, and she is presumed innocent. When the court's recording system comes back, Florida Highway Patrol Trooper Darin Harper walks the jury through his own photographs of the scene and the car. Then the defense takes its turn. Here is what I'm watching. Daniel Waterman's own words are not before this jury, so the State has to prove recklessness through the people who came after and the car's recorded data. This trooper says the data was not pulled at the scene, and that it played a role in whether charges were filed. He also says he is not proficient in reading it, yet his reading went into his report. After a bench conference of about four minutes, the defense says it will ask him nothing more on that point. How much weight should his summary carry? --- WATCH WITH JUSTICE 0:00:00 What this video is, and a preview 0:00:19 to 0:01:50 - Video starts: The court's recording system is back up and the jury returns to the same trooper on the stand. 0:01:50 to 0:02:51 - The State takes him back to the road: dry, no debris, no fluids, all four tires intact. Each one is her question and his yes. 0:02:51 to 0:06:13 - He looks through his own photographs of the crash site and tells the jury they show it as he saw it. 0:06:13 to 0:07:58 - The photos start at the road. In his words, the skid mark comes off the roadway, across the white line and into the grass. 0:07:58 to 0:10:26 - The marks lead to the wood line, a damaged tree, and the car, which he agrees was pretty deep into the woods. 0:10:26 to 0:12:20 - Inside the car: what he calls the components of the dashboard, which he agrees the impact broke loose. 0:12:20 to 0:15:04 - The front end, pushed back toward the passenger compartment, with tree debris in it. Every tire, he says, was still inflated. 0:15:04 to 0:15:40 - The defense cross opens on one point: were there any civilian witnesses to the crash? "Not that I saw." 0:15:40 to 0:16:37 - He agrees he is not an accident reconstruction expert. Then the defense asks if he suspected a crime that night. 0:16:37 to 0:17:22 - The State comes back: when did the car's recorded data come in, and did it play a role in whether charges were filed? 0:17:22 to 0:18:57 - Recross: why sum up the car's data in two-second windows? "I'm not proficient in reading the EDRs, so I just did the best that I could." 0:18:57 to 0:19:57 - The trooper steps down, and the judge calls a short recess. --- COMPLETE CASE COVERAGE justiceisaprocess.com SUBSCRIBE for daily trial coverage and hit the notification bell so you never miss testimony.
