The paramedic climbed into the back seat to reach Daniel Waterman, and she couldn't get to him. The door beside him was caved in. Then she checked for a pulse. This is the Dying Last Words Trial: State of Florida v. Leigha Mumby, in Flagler County, Florida. On the night of February 9, 2025, the white Honda Passport Leigha Mumby was driving left I-95 northbound and ended up in the wood line. Her boyfriend, Daniel Waterman, 22, was in the passenger seat. He died that October. She is on trial for vehicular homicide and reckless driving causing serious bodily injury, and she is presumed innocent. This Part is the two people who came after the crash. Firefighter paramedic Elena Malzahn found the car in the woods, the driver conscious and the passenger slumped toward the dashboard. Florida Highway Patrol Trooper Darin Harper arrived to a clear, dry night with light traffic and one car off the road. Watch how the State builds the scene through them, piece by piece, before the court's recording system goes down and the judge sends the jury out. Here is what I'm watching. Daniel Waterman's own words are not before this jury, so the State has to prove recklessness through the people who came after. The paramedic tells the jury the defendant made one statement about the crash, when she asked how fast she was going, and nothing else. Then the defense puts her own report to her: emotional shock and stress. How much weight can one answer from a bleeding driver in that state carry? And the trooper, who agrees on the State's own question that he is not an accident reconstruction investigator, noticed no debris, no fluids and no impact on the road. Ask what that tells you, and what it doesn't. --- WATCH WITH JUSTICE 0:00:00 What this video is, and a preview 0:00:17 to 0:02:23 - Video starts: Before the jury comes back in, the judge and the lawyers plan the rest of the day 0:02:23 to 0:06:41 - The jury returns and the State calls a firefighter paramedic 0:06:41 to 0:08:05 - The paramedic reaches the car in the woods 0:08:05 to 0:09:08 - What she found when she checked the passenger 0:09:08 to 0:10:10 - The driver's injuries, as the paramedic saw them 0:10:10 to 0:12:19 - What the defendant told the paramedic when asked how fast she was going 0:12:19 to 0:16:33 - The defense cross: emotional shock and stress 0:16:33 to 0:19:13 - A Florida Highway Patrol trooper takes the stand 0:19:13 to 0:20:31 - What the trooper saw when he arrived 0:20:31 to 0:21:33 - The trooper points out the driver in the courtroom 0:21:33 to 0:23:45 - Debris, fluids and marks on the road: the trooper's answers --- COMPLETE CASE COVERAGE justiceisaprocess.com SUBSCRIBE for daily trial coverage and hit the notification bell so you never miss testimony.
