Day 1 of the Buried Beneath the Snow Trial, State of Wisconsin v. Timothy Hauschultz, in Manitowoc County Circuit Court. Five moments from the first day, each one played whole, with a card in front of it telling you what to watch for. The question this trial turns on was set out in the openings. Timothy Hauschultz, Ethan's great-uncle and guardian, was away from the house on April 20, 2018. His teenage son was in the yard with Ethan. The State says Hauschultz chose the punishment, the time and the log, and put his son in charge. The defense says he told his son to leave Ethan alone, and his son did not listen. 0:00 What this video is, and a preview 0:20 Video starts: 1. The openings: who set the punishment, and who carried it out 27:32 2. The ER doctor: no one could tell her why Ethan was so cold 36:12 3. The special agent: what he says Hauschultz told him at the hospital 50:39 4. The juvenile records: the judge's ruling and the defense's correction 55:47 5. The retired detective: "his discipline," and "he wasn't there" 1:06:20 All of Day 1, uncut: the No Breaks Edition WHY THESE FIVE 1. Both openings, nearly whole. Every witness after this gets measured against one of these two accounts, so you need both in your head. Watch the State walk through who decided what, then watch the defense answer with the phone call. 2. Dr. Rebecca Reim treated Ethan in the ER, and for five hours they worked to bring his temperature up. She says the adults who brought him in told her they were not sure what happened because they were not home. That line can help either side, and the jury heard it from the doctor who was in the room. 3. A special agent recounts what Hauschultz told him at the hospital: three phone calls from home, how long he says he was gone, what he says he saw in the backyard, and what he said when asked about calling 911. This is his own account as the agent remembers it, so listen for what the agent says he asked and what he says came back. 4. With the jury out, the judge restates his ruling on the juvenile records: they were reviewed, and both sides have them. Then the defense corrects the record and says 446 of the 450 pages were never reviewed by any court. This is a process moment, and I put it in the five because it shapes what the defense can put to a witness on cross. 5. Retired detective James Michel says Hauschultz called the wood carrying his discipline. On cross, the defense draws out that Hauschultz kept telling him he did not know, because he was not there. Both halves sit back to back, so you can weigh them yourself. My read after Day 1: the State's opening pinned the decisions on him, and what the witnesses said he told them fits that shape. The defense's answer showed up on cross, and it is simple: he was not there. Neither of those is a verdict. We are not the jury, and only the jurors decide.
