Three calls came from the house on April 20, 2018, and every one went to the man raising Ethan. The deputy who questioned him tells the jury what he said back. This is the Buried Beneath the Snow Trial: the State of Wisconsin v. Timothy Hauschultz, in Manitowoc County Circuit Court. Ethan Hauschultz was 7 when he died in April 2018. Timothy Hauschultz, his great-uncle and court-appointed guardian, has pleaded not guilty to six charges, including neglecting a child with death as the consequence. He was not home that day. The State says he set the punishment, carrying wood in wet snow, and left a teenager in charge. The defense says the teenager went beyond what he was told. The State's third witness was a sheriff's deputy in April 2018 and is a special agent now. He was sent to the hospital that afternoon, and he is the one who spoke with the guardian there and asked what happened. Watch his answers on the calls: the first one missed, the second about Ethan not carrying his wood, the third saying Ethan was not responding. He tells the jury the guardian's answer to the second was "let him sit there or something to that effect." Then follow the drive he lays out on a map, north toward one hospital before Ethan reached another, and the kitchen whiteboard he found when he went back to the house that night. Then watch the defense take the same calls and ask different questions: how far an ambulance would have had to drive, who he actually spoke to that day, and how much of that yard he saw for himself. His answer to the last one: "I did not step off of the deck." The question I keep coming back to is the one the State puts to him out loud: "Did you ask him about calling 911 at all?" Three calls is three chances to know something was wrong. The defense's answer is that nobody in that courtroom knows how long an ambulance would have taken to get out there. On cross the jury also hears a recording, Exhibit 12, for itself, and it comes back a second time before he steps down. I think this testimony leans toward the State, and the scale at the end says why. But we're not the jury, and only the jurors decide. --- WATCH WITH JUSTICE 0:00 What this video is, and a preview 0:19 Video starts: The deputy who questioned the guardian, called by the State 13:52 Places the three calls from home on the guardian's own phone 29:24 Links the drive between two hospitals to the 911 question, then the backyard 41:46 Takes the jury back into the kitchen that night, to the whiteboard 52:49 After lunch, the State's photographs from inside the house 58:10 The defense confronts the calls and the ambulance; Exhibit 12 is played 1:10:20 The defense exposes who he never spoke to, and the deck he never left 1:22:20 The State's last questions, then the recording a second time 1:29:52 Who did this testimony help?
