वसीयत के बाद दोबारा बंटवारा नहीं ! एक घर, तीन मंज़िलें और 1998 की एक वसीयत… लेकिन करीब 60 साल बाद वही संपत्ति परिवार को अदालत तक ले गई। इस कहानी में दिल्ली हाई कोर्ट के सामने सवाल था कि जब दादी ने अपनी वसीयत में साफ़-साफ़ तय कर दिया था कि कौन सी मंज़िल किस वारिस के हिस्से में जाएगी, और सभी वारिसों ने वर्षों तक अपने-अपने हिस्से को स्वीकार करके इस्तेमाल किया, तो क्या बाद में उसी संपत्ति के दोबारा बंटवारे की मांग की जा सकती है? मामला Order XII Rule 6 CPC, वसीयत के तहत मिले अधिकार, property partition और लंबे समय तक अपने हिस्से का इस्तेमाल करने से जुड़े महत्वपूर्ण कानूनी सवालों से जुड़ा है। कोर्ट ने माना कि अगर वसीयत के जरिए संपत्ति पहले ही अलग-अलग हिस्सों में बांट दी गई हो और वारिसों ने उसे स्वीकार कर वर्षों तक अपने हिस्से का इस्तेमाल किया हो, तो केवल जर्जर मकान, रास्ते की परेशानी या नए construction में दिक्कत के आधार पर दोबारा partition की मांग नहीं की जा सकती। इस वीडियो में जानिए इस फैसले से जुड़े महत्वपूर्ण Property Law और Succession Law के सबक। Judgment Details:- Sonia Sahni & Anr. vs. Kamlesh Kapoor (Since Decd.) The case raises an important legal question: when a grandmother clearly distributes different floors of a property among her heirs through a Will, and the heirs accept and enjoy their respective portions for years, can they later seek partition of the entire property again? The dispute involved Order XII Rule 6 CPC, Will-based ownership, property partition, succession rights and long-standing acceptance of separate portions. The Delhi High Court held that where the Will had already clearly divided the property and the beneficiaries had accepted and enjoyed their respective portions for years without challenging the Will, difficulties such as a dilapidated structure, access problems or inability to undertake new construction do not by themselves create a fresh right to seek partition.
