SIBIYA BAIL HEARING | Day 3: State Opposes Bail, Lawyer Grilled Over NDPP Letter | Randburg Magistrates' Court
Suspended Deputy National Police Commissioner Lt-Gen Shadrack Sibiya was back at the Randburg Magistrates' Court on Thursday, 1 October 2026, for the continuation of his bail application. The hearing was postponed to Friday with no ruling, so he spent another night in custody at Kgosi Mampuru II.
In this episode:
The state cross-examines Sibiya's attorney, Advocate Rashad Moosa, over the letter his legal team sent to the NDPP before the 21 September arrest
The state puts it to Moosa that the letter was meant to prevent the arrest, and Moosa rejects this
Investigating officer Det Sgt Nokukhanya Ndlovu of the Commission Recommendations Task Team takes the stand
Ndlovu tells the court the state's case is "very strong", citing WhatsApp messages, cellphone records and eyewitness accounts
The state's grounds for opposing bail, including its concerns about witness interference
A new firearm-related charge is added to the charge sheet
A further SAPS disciplinary notice is served, ahead of the 5 October disciplinary hearing
Why Schedule 6 places a heavier burden on Sibiya to show exceptional circumstances
