Washington's 2026 Supreme Court elections are drawing attention as candidates Shawn O'Donnell and Ian Burke face questions about voter initiative rights, judicial independence and the controversial ruling invalidating Initiative 2066.
During a judicial debate, both candidates were asked whether the Washington Supreme Court's decision to strike down the voter-approved natural gas initiative raises concerns about the constitutional initiative process.
Initiative 2066 was approved by Washington voters in 2024 but subsequently invalidated by the state Supreme Court in a 6-3 decision based on the single-subject rule.
O'Donnell emphasized that the initiative power is protected by Washington's constitution and must be respected, while declining to second-guess the ruling. Burke also defended the importance of the initiative process while explaining that constitutional restrictions, including the single-subject rule, apply to voter-approved laws.
The debate comes amid heightened attention to Washington Supreme Court elections, with five of the court's nine positions appearing on the 2026 ballot. The contest between O'Donnell and Burke has also drawn attention over campaign spending, partisan endorsements and questions about judicial impartiality.
