A DoorDash driver is stopped after an officer says he clocked her traveling at 116 MPH with no rear lights and nearly striking multiple vehicles.
During the traffic stop, the driver tells police she was completing a DoorDash order and trying to get the best tip possible. She initially says she had only one glass of wine, later describing it as roughly a glass and a half.
Officers conduct field sobriety exercises before arresting her for driving under the influence. During evidentiary breath testing, the two samples register 0.23 and 0.24, with the lower 0.23 result being used.
In this legal analysis, we examine the 116 MPH traffic stop, field sobriety testing, DUI arrest, Oklahoma implied-consent warning, evidentiary breath testing, and why the officer describes the case as aggravated DUI.
This video is presented for educational and commentary purposes and analyzes the police procedure and legal issues captured in the footage.
