This video teaches Learning Outcome 2 of Unit 6, Health and Safety Law, Regulation and Influence, from the OTHM Level 6 Diploma in Occupational Health and Safety. You learn who owes which duty under the Health and Safety at Work etc. Act 1974, how the Management of Health and Safety at Work Regulations 1999 set the management routine, and how reasonably practicable, the burden of proof in s.40 and approved codes of practice work in practice. We evaluate goal-setting law, civil liability and the common law duty of care, using Wilsons and Clyde v English, Caparo v Dickman and Walker v Northumberland County Council. We then examine requirements for products, services, contractors, visitors, employees, equipment, goods and materials, using HSWA s.6, CDM 2015, the HSG159 contractor steps, R v Associated Octel and Rana Plaza. The final part covers quality and safety management systems and the unique challenges of size, sector, multinational operation, migrant labour and gig work, with compliance planning and review. It is for health and safety officers, supervisors and managers in the UK, the Gulf, Africa and South Asia who want to work towards CertIOSH or the OTHM Level 7 Diploma.
