Day 5 of the Faith Hedgepeth trial in Durham County Superior Court ran from the lead investigator's last answers to the State Crime Lab's print examiner on the stand, and these are the five moments I think mattered most. The lead investigator finished. The defense went back over the 2021 street stop the jury had already watched on video. With the jury out, the lawyers fought over whether the jury could hear that a second examiner checked the fingerprint work. Then the examiner told the jury her section is not set up as a clean section, and late in the afternoon she gave her results on the blue Riesling bottle. Her identification is her opinion as an expert witness for the State. The defendant is presumed innocent, and only the jurors decide what any of it is worth. CHAPTERS 0:00 What this video is, and a preview 0:17 Moment 1: Captain Johnnie Britt, lead investigator, on redirect and recross. Every lead, she says, led back to the DNA. Why it made the five: this is where the State's lead investigator closed out, and she put two years of work into one answer. On recross the defense asked about the Lexus blood sample, and she said she would have to look at a lab report to know if it held DNA. 6:59 Moment 2: Cesar Gutierrez, SBI special agent in 2021, cross-examined on the street stop. Why it made the five: the jury saw the recorded stop, and here both sides argue what it means. Mr. Rainsford says two people approached the defendant on the street and kept asking him to get in a car, and that no one said Faith's name or that she was a UNC student. The State answers that he was told more than once it happened in 2012, and that he said he did not know the woman in the photo. 22:56 Moment 3: Jury out. The defense objects to testimony about the verification step in the fingerprint analysis. Why it made the five: this is a process moment that shaped the rest of the afternoon. Mr. Murphy argued, citing Smith v. Arizona, that examiners who verified her work are not here to be cross-examined, so their check cannot be used to support her opinion. The State said it would not offer anyone else's statements but needed to explain the method. The judge ruled the witness can testify about the verification process, with no out-of-court statements from anyone not present, and noted the objection. The jury heard none of this. 45:39 Moment 4: Summer Maffett, State Crime Lab latent print examiner, on why DNA work comes before prints. Why it made the five: the State's own witness, on direct, said her section is not a clean section and that DNA transfer during her work is possible. In a trial built on DNA, both sides will come back to that answer. 51:09 Moment 5: The blue Riesling bottle. Two fingerprints inconclusive, the palm print an identification. Why it made the five: the headline of the day. In her opinion the palm print on the bottle was left by the same person who made the known prints she compared. The two fingerprints were inconclusive, and she said more complete known prints were needed for them. 57:31 End card: Missed Day 4? Watch Day 4's Top Moments.
