One steering wheel input. The defense told this jury the Dying Last Words Trial comes down to that, and the State answered with six witnesses. This is Day 1 of the trial of Leigha Mumby in Flagler County, Florida. She is charged with vehicular homicide and reckless driving in the February 2025 crash on I-95 that injured her boyfriend, Daniel Waterman. He died eight months later, at 22. She is presumed innocent, and only the jurors decide. The one person who said she crashed on purpose is dead. The judge ruled the jury will not hear a word he said, and the State dropped the one charge that needed intent. Can a car's data, two phone calls and a trooper prove recklessness and a death without him, and what is the jury not being told by either side? The State told jurors they would hear about speeds over 100 miles an hour and an abrupt left turn. The defense asked: did she choose to drive that way, or did something happen in that car that she "did not expect, she did not anticipate, and she did not control"? WITNESS & HEARING GUIDE 0:00:00 What this video is, and a preview 0:00:19 Video starts 0:10:18 Opening statements: the State, then the defense. Two versions of the same turn of the wheel. 0:21:48 Sarah Stappenbeck, first witness for the State. Daniel Waterman's cousin, on the phone calls she says came that night. Watch the defense ask about her own phone records. 0:47:38 Deputy Liam Butler and his body-camera recording. The judge tells jurors it was edited to remove irrelevant portions. The court's feed carries no sound while it plays. 1:22:16 Elena Malzahn, a paramedic at the crash. The State asks if she recalls the response when she asked the driver how fast she was going. Her sworn answer: "She said, I don't know, or I don't know we were fighting, something." 1:35:25 Trooper Darin Harper, the crash investigator. The defense asks how he summarized the car's recorded data. His answer: "At the time, I'm not proficient in reading the EDRs." 2:02:48 Dr. James A. Terzian, the medical examiner, on the cause of death. By video link he calls pneumonia "the terminal mechanism" and says "the actual cause of death there is the motor vehicle collision." The defense asks no questions. 2:22:38 Hearing: The judge and the lawyers go over jury instructions. The jury is at lunch. A working session, not testimony. 2:36:05 Chip O'Toole, crash reconstruction expert for the State. He reads the car's recorded data to the jury, row by row. On cross he calls that data "a strobe light." 3:43:13 Hearing: The State calls no more witnesses, and a defense motion. Jury out. The defense asks the judge to end the case. The judge's words: "I do find that the state has made a prima facie case." 3:46:41 Michael Tolbert, the first witness for the defense. Leigha Mumby's roommate, on a phone call he says lasted "10, 15 seconds." --- COMPLETE CASE COVERAGE justiceisaprocess.com SUBSCRIBE for daily trial coverage and hit the notification bell so you never miss testimony.
